Judiciaire : le DPP ne fera pas appel dans l'affaire Soodhun

Le Bureau du Directeur des Poursuites Publiques (DPP) ne fera pas appel de la décision de la Cour intermédiaire, qui avait prononcé un verdict d'acquittement en faveur de l'ancien no 4 du gouvernement, Showkutally Soodhun, le 25 septembre dernier. C'est ce qui ressort d'un communiqué émis par le bureau DPP ce vendredi 4 octobre.

«The Office of the Director of Public Prosecutions (ODPP) has taken cognizance of the judgment delivered by the learned Magistrate in the above matter. The ODPP takes note of the fact that the learned Magistrate concurred with all the views of the Prosecution on issues of law. However, she found the main witness for the Prosecution, on whom the case of the Prosecution essentially rested, not to be a reliable witness. The learned Magistrate has made a number of findings of fact to conclude that it would be unsafe to rely on the testimony of that witness to convict Honourable Showkutally Soodhun. The ODPP has not found these findings of fact to be unreasonable or perverse so as to warrant an appeal. In these circumstances, the ODPP has today advised the Commissioner of Police that there should be no further action in this matter», peut-on lire dans le communiqué.

L’ancien vice-Premier ministre et ministre du Logement, Showkutally Soodhun, a été acquitté par la magistrate Meenakshi Gayan-Jaulimsing, dans le procès qui lui était intenté pour abus de pouvoirs dans le cadre des propos discriminatoires qu’il aurait tenus lors d'une réunion le 17 juillet 2017 à son ministère. Il était poursuivi sous une accusation de «abuse of authority by public officer».

La Poursuite reprochait à Showkutally Soodhun de s'être engagé, le 17 juillet 2017, auprès des personnes réunies sous le « Regroupement de Bassin » pour que les maisons National Housing Development Company Ltd (NHDC) de leur localité soient allouées à des personnes de manière discriminatoire, soit en violation de l’article 16(2) & 16 (3) de la Constitution. Le député de la circonscription no 15 (La Caverne/Phoenix) avait plaidé non coupable.
